This “Privacy Policy” governs the use of information by Poised IT Consultants Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at F-15, First Floor, Block D 242, Sector 63, Noida 201301 (hereinafter referred to as “Eindhan”, “Eindhan.in” “we” or “us”) that is obtained through the use of its website https://eindhan.in (“Website”) by the users.

1. WHAT DOES THIS POLICY COVER?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Mobile applications and website (www.eindhan.in).

2. Consent

By visiting or using the www.eindhan.in website and mobile applications, you agree to the practices and policies set forth in this Privacy Policy, and you hereby acknowledge and consent to our collection, use, and sharing of your information as described in this Privacy Policy. Also, you agree to the point that all personal data shall be retained till such time required for the purpose of Eindhan.in or required under applicable law, whichever is later.

3. Collection of Information and its usage

3.1)  As a visitor to the Site, you can engage in many activities without providing any Personal details. Depending upon the activity, some of the information that we ask you to provide is identified as mandatory because without which it would be difficult for us to serve you and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity. However, we may collect your contact information such as your name, phone numbers, address and email address as well as profile information, including your password, details about your purchases and details about your interactions with us.

3.2)  We may also ask you to provide us information when you fill in a form, conduct a search, respond to surveys, post to community forums, participate in promotions, or use other features on the Website and mobile application(if available and applicable).

3.3)  We may have to collect your personal data if you wish to do business with us in the form of dealership/ distributorship (through dealer/ distributor applications).

3.4)  Financial Information - We do not collect payment card (credit/debit/prepaid/other) details. Our payment happens through a renowned and widely accepted payment gateway. Our payment gateway partner provide us details like mode of payment, transaction details along with date & time and the bank used. We may use this information to provide targeted discounts and promotions.

3.5)  We may ask you to give vehicle details including model, year, colour, vehicle registration number.

3.6)  Geo-location - We may collect information about your precise or approximate location as determined through data such as your IP address or mobile device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu. The Website may also collect this information even when you are not using the mobile application if this connection is enabled through your settings or device permissions.

3.7)  Log details and Device Information  We automatically collect log data and device information when you access and use the Website and the mobile application, even if you have not created an account with Company and/or the Website or logged in. That information includes, among other things: details about how you’ve used the Website (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the Website.

3.10)  Feedback/Reviews - We may chose to reshare customer reviews on Facebook, Instagram and other social media. We may use this data to measure User engagement and to further improvise the customer experiences with us or to upgrade our services. We obtain this data directly when users share our content, our post with our products or tag us.

3.11)  Updating Your Personal Information:
You have the right to access and correct, or delete your Personal Information and privacy preferences at any given time. This may be accomplished by clicking on the link, "My Account", where you can view and make changes to most of your Personal Information immediately. For security purposes, certain Personal Information can only be changed by contacting support. We will respond to your request promptly within a reasonable time.

5.1)  Data/Information Sharing -We collect your information (via Eindhan.in or our mobile applications) in order to provide services to you, comply with our legal obligations, and to improve our products and services. We do not sell, rent or share your personally identifiable information to or with third parties in any way other than as disclosed in this Privacy Policy. Below mentioned are the situations when we may share the information:

5.2)  We collaborate with third party service providers who perform certain business-related functions for us, such as cloud hosting services, software, system, data analysis, customer support service, email delivery service, SMS service and platform support, direct marketing services, advertising, and order fulfillment and delivery and other similar services to enable them to provide services to us.

5.3)  To our business partners (Dealers & Distributors) who provide you, directly or indirectly, with your required Smart Devices through which you access and use our Sites and Services.

Users are advised to exercise caution while clicking on any links. Eindhan.in cannot be held liable/responsible for any damage caused due to external links.

6. CHANGES TO THIS PRIVACY POLICY

We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make changes in the way we use Personal Information, we will notify you by posting an announcement on our website or contacting you directly via email or other means. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. 7. Data Accuracy

It is in User’s interest as well as in Eindhan.in objective, to have accurate, current and complete data concerning users and their account. At any given time, If you believe that we have incorrect information about you or your accounts, please intimate us. We will correct any false information with immediate effect.

8. Force Majeure

Notwithstanding anything contained in this Policy or terms of use or other terms and condition on the Website or elsewhere, Eindhan.in shall not be held responsible for any loss, damage or misuse of your personal data, if such loss, damage or misuse is attributable to a Force Majeure Event (as mentioned below).

8.1)  ‘Force Majeure Event’ shall mean any event that is beyond the reasonable control of Eindhan.in and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer, computer system or computer network, computer crashes, breach of security and encryption (provided beyond reasonable control of Eindhan, (a brand of Poised IT Consultants Pvt Ltd.)), power or electricity failure or unavailability of adequate power or electricity.

8.2)  2 While Eindhan.in will endeavour to take all reasonable and appropriate steps to keep secure any personal data which we hold about users and prevent unauthorized access, users acknowledge that the internet or computer networks are not fully secure and that Eindhan.in cannot provide any absolute assurance regarding the security of users personal data.

9. Grievance Officer

This page is published and shall be construed in accordance with the provisions of Rule 3(11) of the Information Technology (Intermediaries Guidelines) Rules, 2011 (“IT Rules”) that requires publishing the name of the Grievance Officer and his/her contact details on the website, such that users or any victim who suffers as a result of a violation of Rule 3 (outlined in our Privacy Policy and Terms of Use) by any other person, can notify their complaints to us.

Further, as per Rule 3(4) of the IT Rules, the Grievance Officer shall acknowledge or respond to Your communication of violation of Rule 3, by any other person, within 36 (thirty six) hours, and the complaints shall be redressed within 1 (one) month from the date of receipt of the complaint.

10. Arbitration

Any dispute arising out of or relating to this Agreement, or the breach thereof, whether occurring while this Agreement is in effect or thereafter, shall be submitted exclusively to binding arbitration conducted in accordance with the provisions of the (Indian) Arbitration and Conciliation Act, 1996. The arbitration proceedings shall take place at Noida, India and in the English language.

11. Governing Law and Jurisdiction

This Agreement shall be construed in accordance with the applicable laws of the Republic of India. The parties consent to the exclusive jurisdiction and venue of the courts in the city of Noida, India.
